SafetySight Terms of Service

1. Accepting these Terms
These Terms govern access to and use of SafetySight. By creating an account or using SafetySight, you agree to them. If you use SafetySight for an organisation, you confirm that you are authorised to do so.
If SafetySight and your organisation sign a separate pilot, enterprise or other written agreement, that agreement prevails to the extent of any inconsistency.
2. What SafetySight does
SafetySight is software intended to help organisations record and manage first-aid kit checks, entered expiry dates, follow-up actions and associated workplace records. Available functionality may depend on the plan and product version.
3. SafetySight does not certify compliance
SafetySight supports a customer's process. It does not provide legal or medical advice, certify WHS compliance, replace workplace risk assessments or competent physical inspections, assume an organisation's safety duties, or act as an emergency service.
A status, record, reminder or automated result in SafetySight does not by itself establish that a workplace complies with applicable law, codes or standards.
4. Customer responsibilities
Customers remain responsible for their legal obligations, workplace risk assessments, first-aid arrangements, equipment, trained personnel, physical inspections, accuracy of entered information, review of SafetySight outputs and final workplace-safety decisions.
SafetySight must not be used as the sole emergency-response system for a workplace.
5. SightScan and automated results
SightScan and other automated features may make mistakes, including when identifying an item, reading text or expiry information, determining a quantity or interpreting an incomplete image. Users must review results where they may materially affect a workplace-safety decision.
6. Accounts and access
You must provide accurate account information and protect your login access. Organisations are responsible for deciding who may access their workplace, assigning appropriate permissions and removing access when it is no longer required.
Notify SafetySight promptly if you suspect unauthorised access.
7. Customer content
Customers retain ownership of information, images and documents they provide to SafetySight. Customers grant SafetySight the rights reasonably necessary to host, process, transmit, display, analyse, back up and otherwise handle that content to provide, maintain, secure and support the service.
Customers must have the authority to provide that content and are responsible for its accuracy.
8. Acceptable use
You must not use SafetySight unlawfully; access information without authority; circumvent security or permissions; disrupt the service; introduce malicious software; exploit a vulnerability; upload content you have no right to provide; resell access without permission; or use SafetySight to harm another person, customer or the platform.
Suspected security issues should be reported privately to info.safetysight@gmail.com.
9. Plans and payments
Free-plan limits are displayed on the SafetySight website. Any paid price, billing period, GST treatment, renewal arrangement, trial condition and applicable usage limit will be displayed before you accept a paid subscription or recorded in a separate written agreement.
SafetySight will not charge an undisclosed mandatory fee. Pilot and enterprise customers may have separate commercial terms.
10. Product development and availability
SafetySight is actively developed. We may improve, add, change or discontinue functionality and may provide beta or preview features. Demonstrations, roadmaps and discussions are not commitments to deliver future functionality unless expressly agreed in writing.
We aim to provide a reliable service but do not guarantee uninterrupted availability. Maintenance, defects, security work, provider outages or events beyond reasonable control may affect access.
11. Intellectual property and feedback
SafetySight and its licensors retain rights in the software, product design, interfaces, workflows, branding and related intellectual property. Using SafetySight does not transfer ownership of those materials.
SafetySight may use feedback to improve its products, but will not publicly identify confidential customer feedback without permission.
12. Suspension and termination
SafetySight may restrict or suspend access where reasonably necessary to address a security risk, unlawful activity, material misuse, overdue payment or a serious breach of these Terms. Where practicable, we will provide notice and an opportunity to resolve the issue.
You may stop using a free account at any time. Paid cancellation and post-termination access will follow the conditions presented and accepted for that subscription or a separate agreement.
13. Privacy
Our handling of personal information is described in the SafetySight Privacy Policy. Customers must ensure they have appropriate authority before entering personal information into SafetySight.
14. Non-excludable rights
Nothing in these Terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including applicable rights under the Australian Consumer Law.
15. Responsibility for information and use
To the extent permitted by law, SafetySight is not responsible for loss caused solely by inaccurate customer information, a failure to perform required physical checks, a failure to act on known safety information, use outside the documented purpose, or reliance on an automated result contrary to an express review warning.
16. Changes to these Terms
The current version will be published with its effective date. We will take reasonable steps to notify existing users of a material change before it takes effect. If a material change is unacceptable, you may stop using the service and cancel an affected recurring subscription before the change takes effect, subject to any separate written agreement.
